The petitioner is apprehending his arrest in connection with Adityapur P.S. Case No.01 of 2025, for offence registered under section 103/ 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Seraikella.

Learned counsel for petitioner submits that in the FIR the allegation is made that on the eve of new year one XUV was occupied by the persons have indulged in alteration with the rider of the motorcycle who was taken to TMH Jamshedpur for treatment and subsequently died. He next submits that the police has investigated the area where the accident took place and tried to find out the things from the local shopkeepers and even the CCTV footage was examined but nothing has come in the CCTV footage. of the police has informed that the XUV having the black tag was involved in the said crime and pursuant to that the said XUV has been seized. He next submits that Arpan Kumar @ Arpan Singh who is the son of the owner of the XUV and that person used to drive the said XUV and that has come in paragraph no.94 of the case diary. He next submits that the petitioner is the friend of Arpan Kumar @ Arpan Singh. He next submits that Arpan Kumar @ Arpan Singh along with one Om Mishra @ Om Kumar Mishra have been granted anticipatory bail in ABA No.5241 of 2025. He next submits that only on suspicion the name of the petitioner has come and the FIR is against four unknown persons and the CCTV aspect has been noted in paragraph no.12 of the case diary and nothing has come in the CCTV footage. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned State counsel opposes prayer and submits that witnesses have supported the prosecution case and even the mother of Om Mishra @ Om Kumar Mishra in paragraph no.99 of the case diary has stated that her son was upset on that day and has disclosed that altercation took place. 5.
In light of the above submission of the learned counsel for the parties and after perusing the contents of the FIR it transpires that the petitioner is not named in the FIR and even the number of the XUV is not stated in the FIR and the said altercation

took place on the eve of new year, and in paragraph no.12 of the case diary, it has come that in the CCTV footage nothing is found and even the nearby shopkeepers have stated nothing and two of the co-accused persons have already been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Adityapur P.S. Case No.01 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023. ( Sanjay Kumar Dwivedi, J.) 11.02.2026 SI/
