Deka, learned counsel for the petitioner, on instruction, submits that after filing of the present writ petition, the respondent authorities have finalized a select list for promotion against the vacant posts of Head Master existing in the provincialized high schools situated in the district of Morigaon. In view of the said developments, he prays that he be permitted to withdraw the present writ petition with liberty to institute fresh proceeding assailing the said select list. The prayer is not objected to by Mr. S.M.T. Chistie, learned standing counsel, School Education. Accordingly, the present writ petition stands dismissed with liberty as prayed for.
