1. The present writ petition has been filed seeking a direction to respondent no. 1/MCD to demolish the unauthorised construction carried out by respondent no. 3 in Flat No. 74B, AP Block, Pitampura, Delhi (‘subject property’). 2. A fresh status report has been filed by way of affidavit on behalf of respondent no.1/MCD, wherein it is stated that after following due process This is a digitally signed order. W.P.(C) 1362/2026 of law, a demolition order has been passed on 20th May, 2026 in respect of the unauthorized construction in the shape of an extra room at the front portion of the subject property. It is further stated that an appeal has been filed by the private respondent no.3 against the said order, which is listed before the ATMCD tomorrow, i.e. 29th July, 2026. 3. The status report records that the property of the petitioner has also been booked on 14th May, 2026 for unauthorized construction and a demolition order has been passed in respect thereof on 5th June, 2026. 4. In view thereof, the present petition is disposed of while directing respondent no.1/MCD to take appropriate action in accordance with law, based on the outcome of the interim application filed by the respondent before the ATMCD. 5. In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law. 6. All rights, contentions and legal remedies of the private respondent shall remain protected.
