25.03.2026 Heard Shri R Pradhan, learned counsel for the petitioners. Also heard Shri Shashank Thakur, learned Addl AG, and Shri Sourabh Sahu, learned PL, appearing for the respondent/State.
1. Petitioners have filed the present petition with the following prayer:
“It is, therefore, prayed that this Hon’ble Court may kindly be pleased to allow the application and further be pleased to stay the criminal proceeding bearing Criminal Case No.3563/2024 pending before the learned Judicial magistrate First Class Balodabazar, District Balodabazar Bhatapara (CG), till the final decision of the petition, in the interest of justice.”
2. On 16.03.2026, learned counsel for the petitioners is directed to file certified copy of the charge framed before the learned trial Court.

Learned counsel for the petitioners would submit that though the petitioners have applied for certified copy of the charge memo, and order framing the charge, however, the same could not be supplied till date, and therefore, he prays for some time.
4. Since this Court has already granted time on the last date of hearing to file certified copy of the charge memo and today also again same prayer is being made by learned counsel for the petitioners, we are not inclined to grant any further time for keeping the matter pending for this purpose.

5. At this stage, learned counsel for the petitioners seeks permission to withdraw the petition with liberty to file a fresh and duly constituted petition, challenging the order framing charge.
6. In view of the above submission made by learned counsel for the petitioners, the present petition stands dismissed as withdrawn with liberty as prayed for.
7. Certified copy of the documents/annexures shall be returned to
