This contempt petition has been filed by the petitioner under Article 215 of the Constitution of India r/w. Section 12 of the Contempt of Courts Act, 1971 alleging non-compliance of the order dated 21.01.2025 passed by this Court in WP(C) No. 5373/2025. 2. Learned counsel for the petitioner submits that while passing the order, the Writ Court has issued specific direction to resolve the dispute within 15 days. He contended that though the dispute has been resolved, however, the 2 proceedings have not been concluded by the respondents within time specified/prescribed by the Court in its order dated 11.01.2025 and therefore, the respondent contempt of the order of Court. 3. Learned counsel for the respondent submits that after receipt of the order, respondent have taken all necessary steps for complying with the directives issued by this Court, proceedings were drawn. Statement of the persons have been recorded and thereafter, based upon which, memo was issued to the petitioners 17.06.2025. Upon enquiry, it revealed that the petitioners herein, were not expelled from the society. 4. I have heard learned counsel for the respective parties and perused the documents placed on record. 5. The main contention of counsel for the petitioner is that though the order passed in writ petition has been complied, however, it is with delay of more than 06 months from the time fixed by the Court. The operative portion of the order dated 21.01.2025 is extracted below for ready reference:- 6. The petitioner has filed this writ petition seeking following reliefs:- “5. Looking to the grievance of the petitioners that the petitioners and their family members are alleged to be boycotted by Respondent No. 3, the Respondent No. 1/District Collector, District North Bastar, Kanker is directed to look into the matter and take necessary stamps to resolve the grievance raised by the petitioners within a period of 15 days from the date of receipt of a copy of this order.” Perusal of the order would show that the direction issued to the Respondent No. 1 therein/Collector to take necessary steps to resolve the grievance raised by the petitioner. It appears from the proceedings placed on record i.e. report dated 17.06.2025 (Annexure R/1), that the Collector has initiated the proceedings and initially, the Tehsildar has written a letter on 05.03.2025 mentioning that the petitioners in the writ petition have not been expelled from the society. Again, the Sub-Divisional Officer (R) on the letter of the Petitioner No. 1 dated 25.04.2025 have conducted an enquiry and concluded that the petitioner herein is not expelled from the society. There is also an 3 endorsement at the bottom of memo dated 17.06.2025 that Petitioner No. 1 refused to accept the copy of the memo and thereafter, two copies of memo were affixed at the outer wall of the house of the Petitioner No. 1. This endorsement is signed by Village Patel, Village Kotwar, Member of Gram Panchayat and Process Server. This apart, the respondent has tendered unconditional apology which is supported by an Affidavit. 7. In the above facts of the case, in the opinion of this Court, direction issued by the Court in WP(C) No. 5373/2025 has been complied with. 8. Accordingly, the contempt proceedings initiated against the respondents is dropped. 9. Notices issued to the respondents stands discharged. Contempt petition is closed.
