The petitioner, above-named, who is in custody in connection with Jorapokhar (Dhanbad) P.S. Case No. 103 of 2025 (Special POCSO Case No.133 of 2025) for the offence registered under Sections 65(1), 62 of the BNS, 2023 and under Sections 8 & 12 of the POCSO Act, has prayed for regular bail. It is submitted by the learned Senior counsel on behalf of petitioner that after investigation, charge-sheet has been submitted for kidnapping under Section 87 of BNS, 2023 and under Section 4(2) of the POCSO Act. It is further submitted that her statement was recorded wherein she has developed her case and exaggerated the allegation which is in contradiction to her statement given to the Police. Learned A.P.P. for the State has opposed the prayer for bail. It is submitted that petitioner is named in the FIR and there is direct and specific allegation against him of committing rape. Considering the nature of allegation and gravity of offence, this Court is not inclined to enlarge the petitioner on bail and accordingly, the same is hereby rejected. (Gautam Kumar Choudhary, J.)
