Order 08/04/2026
1. This bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 441/2025 registered at Police Station Amer, District Jaipur City (North) for offence u/S 8/21, 8/29 of the NDPS Act and Section 111(2)(B) of the BNS.
2. Heard learned counsel for the petitioner as well as the Public Prosecutor.
3.
Learned counsel for the accused petitioner submits that the accused petitioner has been made an accused with the fake recovery of 13.33 gm. of illegal drug smack. He further submits that the accused petitioner is in custody since 26.02.2026 and he is no more required for any kind of interrogation and recovery. He further submits that alleged recovery from the possession of the
[2026:RJ-JP:14667] (2 of 2) [CRLMB-4048/2026] accused petitioner is less than the commercial quantity, therefore the petitioner may be released on bail.
4. Learned Public Prosecutor vehemently opposed the bail application and submits that the petitioner is in habit of misusing the liberty of bail. He further submits that three other criminal cases of similar nature i.e. punishable under the NDPS Act are pending against the accused petitioner.
5. Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor.
6. 13.33 gm. illegal drug smack is said to have been recovered from the possession of the accused petitioner. The accused petitioner is facing three other criminal cases for offence punishable under the NDPS Act. The commission of offence by the petitioner even after he has been extended the benefit of bail in earlier criminal cases of NDPS Act shows that he has no fear of law and he is in habit of misusing the liberty of bail.
7. Taking into consideration the fact that three other criminal cases of similar nature were already pending against the accused petitioner when he has committed the third offence punishable under the NDPS Act, and the fact that the accused petitioner has misused the liberty of bail granted to him in earlier three criminal cases, this Court is not inclined to enlarge the accused petitioner on bail.
8. Hence this bail application is dismissed.
