GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief :- “…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the Respondent No.l in refusing to conduct further investigation in FIR No.477/2024 by way of conducting scientific investigation for establishing the allegation of forgery and sending the forged document along with admitted signatures to the Forensic Science Laboratory and before eliciting the allegation of forgery filing the final report as civil in nature as arbitrary, illegal and contrary to the procedure prescribed the provisions of the BNSS and in violation of Article 14 and 21 of the Constitution of India and consequently direct the Respondent No.1 to conduct further investigation in FIR No.477/2024 and conclude the allegation of forgery by sending the forged document along with the admitted signatures of the Complainant and the Accused to the FSL through the concerned Magistrate and after receiving the report file appropriate final report before the concerned Court in the interest of justice.” 2. Heard the learned Counsel for the Petitioner and the learned Assistant Government Pleader for Home. 3. Sri P. Nagendra Reddy, learned counsel for the Petitioner, submits that Respondent No. 1 has refused to conduct further investigation in Crime No. 477 of 2024 by scientific methods for establishing the allegation of forgery. 4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, submits that, after conducting a thorough investigation in Crime No. 477 of 2024, the Investigating Officer found that the case is civil in nature. Therefore, he addressed a letter to the SDPO concerned, who accorded permission to refer the case as civil in nature, vide letter dated 17.01.2026. 3 Dr.YLR, J W.P.No.11562 of 2026 Dated 30.04.2026 5. Having regard to the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the Petitioner to approach the learned jurisdictional Magistrate by filing an appropriate application seeking further investigation in the case, inasmuch as an alternative efficacious remedy is available under Section 173(8) of the Code of Criminal Procedure, 1973 or under Section 193(9) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Upon such application being filed, the learned jurisdictional Magistrate shall pass appropriate orders, after hearing both sides, in accordance with law as early as possible preferably within a period of three weeks. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending shall stand closed. _________________________ DR. Y.
