1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“(A) Issue an appropriate writ, order or direction, particularly in the nature of Mandamus, directing Respondent No. 1 to consider, decide and dispose of the Petitioner's com plaint/representation dated 01.09.2025 1n a time-bound manner and in accordance with law; B) Direct Respondent No. 1 to pass a reasoned and speaking
order on the Petitioner's aforesaid complaint/ representation after duly considering the

2. The brief facts of the case are that the petitioner availed a housing loan from respondent No. 2 on 23.07.2022 for the purchase of a residential property, with repayment scheduled through 240 EMIs commencing from
05.10.2022. On 05.03.2024, the petitioner foreclosed the loan by remitting a total sum of Rs. 1,90,00,000/-, out of which Rs. 1,81,83,201/- was appropriated towards the outstanding principal liability. 3. Despite complete repayment of the loan, respondent No. 2 unlawfully levied foreclosure charges of Rs. 10,90,716/- and recovered a total amount of approximately Rs. 12,89,221/- (inclusive of applicable taxes), which the petitioner paid under protest to secure closure of the loan account and release of the mortgaged property documents. 4. Thereafter, the petitioner repeatedly requested respondent No. 2 through e-mails followed by a detailed representation dated 02.06.2025, seeking refund of the illegally recovered foreclosure charges. 5. As no effective action was taken, the petitioner lodged a complaint before respondent No. 1 (Reserve Bank of India) on 01.09.2025. Although respondent No. 1 informed the petitioner on 15.09.2025 that the complaint had been forwarded to Respondent No. 2 for comments, no reasoned decision has been passed on the complaint. 6. Hence the present petition. 7. There is nobody appearing on behalf of the respondents. 8. I am of the view that the petitioner’s email needs to be addressed by the respondent No.1 in accordance with extant rules and regulations. 9. In view of the above, the petition is allowed and it is directed that the respondent No.1 shall decide and dispose of the petitioner’s complaint/representation dated 01.09.2025 in accordance with extant rules, regulations and RBI guidelines and pass a speaking order expeditiously and not later than 4 weeks from today. 10.
The petition is disposed of in the aforesaid terms. 11.
