ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.4/2024.
2. Heard Sri. Manjunath M. Hegde,
learned counsel appearing for petitioner Nos.1, 3, 4 and 5; Sri. Pradeep Kumar R.H., learned counsel appearing for

petitioner No.2; Sri. B.N. Jagadeesha, learned Additional State Public Prosecutor appearing for respondent No.1 and Sri. Akarsh S. Kande, learned counsel appearing for respondent No.2.

Learned counsel for petitioner No.2 has filed a memo seeking permission to withdraw the petition. Memo reads as under:
"The under signed counsel submits the Petitioner No.2 is does not wish to proceed with the above petition as such and wish to withdraw this petition in so far as Petitioner No.2 is concerned. Further, the Petitioner No.2 most humbly seek the liberty to file a fresh petition. Hence, the under signed prays that this Hon'ble Court may kindly be pleased to permit the under signed to withdraw the above petition as not pressed, in the interest of justice and equity."
In terms of the memo, the petition qua petitioner No.2 is disposed as withdrawn.

Learned counsel appearing for the petitioner Nos. 1, 3, 4 and 5 submits that during the pendency of the petition, the Police after investigation have filed the final report-charge sheet against petitioner Nos.1, 3, 4 and 5.

5. In the light of filing of the charge sheet learned counsel appearing for the petitioner Nos.1, 3, 4 and 5, seeks leave of this Court to withdraw the petition and raise a challenge to the charge sheet.
6. Liberty so sought is granted.
7. The petition is disposed as withdrawn.
