[2026:RJ-JP:30356] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11697/2026 CNR: RJHC020701192026 | URN: CRLMB / 21570U / 2026 1. Sonu Nagar S/o Satyanarayan, Aged About 27 Years, R/o Kadaiyavan Presently Resident Of Mal Aancholi Police Station Chhabra Distt. Baran (Raj.) (At Present Confined In Sub Jail Chhabra) 2. Surendra Nagar S/o Satyanarayan, Aged About 26 Years, R/o Kadaiyavan Presently Resident Of Mal Aancholi Police Station Chhabra Distt. Baran (Raj.) (At Present Confined In Sub Jail Chhabra) ----Petitioners Versus State of Rajasthan, through P.P. ----Respondent For Petitioner(s) : Mr. Nem Singh Gurjar Mr. K.N. Sharma For Respondent(s) : Mr. Jaiprakash Tiwari, P.P. HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 04/08/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.269/2026 registered at Police Station Chhabra, District Baran for offences under Sections 126(2), 115(2), 331(1) and 3(5) of BNS, 2023. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. It is further submitted that the allegations against the present petitioners are [2026:RJ-JP:30356] (2 of 3) [CRLMB-11697/2026] omnibus in nature. There is no specific allegation attributing the infliction of any life-threatening injury to the petitioners. Further, there is no material on record from which it can be inferred that the injuries sustained by the injured were dangerous to life. He further submits that co-accused Kishangopal has already been enlarged on bail by this Court on 20.07.2026. The case of the present petitioners are on better footing. The petitioners have been in judicial custody since 01.07.2026 though one case has been reported against petitioner - Sonu Nagar and three cases have been reported against the petitioner – Surendra, however, in all cases they are already on bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners - Sonu Nagar S/o Satyanarayan and Surendra Nagar S/o Satyanarayan, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear [2026:RJ-JP:30356] (3 of 3) [CRLMB-11697/2026] before that Court on all subsequent dates of hearing till conclusion of the trial.
