It appears from the affidavit of service that the respondent no. 8 has expired. Her name be expunged from the cause title of the writ petition. The petitioner alleges that the private respondents have raised unauthorised construction by encroaching upon Panchayat road. In reply to an application made under the Right to Information Act, the petitioner has been informed that no permission was granted by the concerned Panchayat for such construction. The petitioner submitted a representation in this regard before the concerned authority on January 22, 2017 which is yet to be considered. On prayer of the petitioner, liberty is granted to submit a fresh comprehensive representation before the Pradhan, Harit Gram Panchayat, being the 5th respondent herein, in this regard within 7 days from date. The 5th respondent is directed to consider and dispose of the same within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondent is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
