1 2026:CGHC:958 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 24 of 2026 Vikram Verma S/o Late Kanshram Verma Aged About 68 Years R/o Tarun Nagar, Pandri, Raipur, Tahsil And District- Raipur (C.G.) ... Applicant versus State of Chhattisgarh Through - Station House O1cer, Police Station- Civil Line, Raipur, District- Raipur (C.G.) ... Non-applicant For Applicant : Mr. Krishna Kumar Dewangan, Advocate. For Non-Applicant/State : Ms. Anusha Naik, Deputy Govt. Advocate Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 07.01.2026 1. This is the second bail application 7led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 431/2025 registered at Police Station- Civil Line, Raipur, District- Raipur (C.G.), for the o<ence punishable under Section 34(2) of the Chhattisgarh Excise Act. 2. The earlier bail application of the applicant has been rejected by this Court vide order dated 17.10.2025 passed in MCRC No. 8402 of 2025 on the ground that applicant has 02 criminal antecedents under the Excise Act. RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN 2 3. The case of the prosecution, in brief, is that the police of Police Station : Civil Line, Raipur, District- Raipur (C.G.), received an information from the informant and on the basis of the said information conducted a raid and seized 14.400 bulk liters of country made liquor from the possession of the present applicant. Thereafter, Police has registered an o<ence punishable under Section 34(2) of the C.G. Excise Act against the present applicant. 4. Learned counsel for the applicant submits that this is the second bail application 7led by the applicant. The 7rst bail application was rejected by this Hon’ble Court on the ground that the applicant had two criminal antecedents of identical nature, in which he is already on bail. It is further submitted that the applicant has been languishing in jail since 07.09.2025, and till date no prosecution evidence has been recorded, though the charge was framed on 10.11.2025. It is submitted that the conclusion of the trial may take considerable time, and therefore, the applicant prays for grant of regular bail to the present applicant. 5. On the other hand, learned State Counsel opposes the bail application of the applicant and submits that a quantity of 14.400 bulk litres of country-made liquor was seized from the possession of the present applicant without any valid licence, and no plausible explanation has been o<ered in this regard. She further submits that the present applicant has two previous criminal antecedents of a similar nature, pertaining to the years 2024 and 2025, which are still pending, and therefore, the applicant is not entitled to the grant of regular bail. 3 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Having considered the submissions made by learned counsel for the parties and the material available on record, it is evident that the applicant is involved in two other cases of an identical nature, one pertaining to the year 2024 and the other to the year 2025, in both of which he is already on bail and the matters are still pending. The present case also pertains to the year 2025, which indicates that the applicant appears to be a habitual o<ender and has misused the liberty of bail. In such circumstances, this Court does not 7nd any su1cient ground to enlarge the applicant on bail. Accordingly, I am not inclined to grant regular bail to the present applicant. 8. Accordingly, the second bail application of the applicant - Vikram Verma, involved in Crime No. 431/2025 registered at Police Station- Civil Line, Raipur, District- Raipur (C.G.), for the o<ence punishable under Section 34(2) of the Chhattisgarh Excise Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. O1ce is directed to send a certi7ed copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/- (Ramesh Sinha) Chief Justice Rahul Dewangan
