CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 07-05-2026 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 302, 328 and 34 of the Indian Penal Code.
3. The case of the prosecution is that the informant alleged that the petitioners who are his uncle have killed his father.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned counsel for the petitioners has submitted that from perusal of the FIR, it transpires that the information regarding death was received to the informant on 22.05.2023 and this case was filed on
23.05.2023. It has further been submitted that there has been
Patna High Court CR. MISC. No.29932 of 2026(2) dt.07-05-2026 2/2 partition between the brothers and even the deceased has sold his shares of land. It has also been submitted that there is no dispute between the petitioners and the deceased. From perusal of the
order of the learned trial court, it transpires that the father of the informant has died due to consumption of CELPHOS. Learned counsel has further submitted that this case is totally based on suspicion. Save and except suspicion, there is nothing against the petitioners. Moreover, they are languishing in judicial custody since 01.02.2026.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Khudwa P.S. Case No. 46 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad.
