1. Pursuant to the order dated 18.03.2026, the respondent-State intends to file supplementary counter- affidavit in W.P.(S) No. 2113 of 2023. 2. The same is taken on record. 3. With consent of the parties the cases are being taken up for hearing today itself. 4. Jharkhand Staff Selection Commission (in short ‘JSSC’) while publishing the Advertisement No. 02/2023 (Regular Vacancy) and Advertisement No. 03/2023 (Backlog Vacancy) for appointment to the post of Post Graduate Trained Teachers in various subjects has advertised fewer seats for the Backward Class II category which is in direct contravention to the Jharkhand Reservation Act, 2001 and the Jharkhand Reservation in Posts and Services Vacancies (For Scheduled Castes, Scheduled Tribes and Backward Classes) (Amendment) Act, 2019 which mandatorily prescribes 6% posts to be reserved for BC-II category in the appointment. 6. The respondent State had initially filed their reply stating that the posts have been advertised as per post- based vacancy and also annexed table showing the total number of working teachers and the shortfall of teachers showing that the seats advertised in the Advertisement No. 02/2023 & Advertisement No. 03/2023 is correct. 7.
Pursuant thereto, the petitioners filed supplementary affidavit dated 16.10.2026 and 01.04.2026 in W.P.(S) No. 2113 of 2023 wherein certain documents like advertisements published in each year in each subject and the number of teachers appointed were annexed in order to

show that the respondent State in their counter affidavit have filed incorrect data. 8. Further, when the said supplementary affidavits filed by the petitioners in W.P.(S) No. 2113 of 2023 before this Court, the respondent State accepted their mistake and has accordingly filed their supplementary counter affidavit ton 21.04.2026 wherein at Para 9, 10, 11 & 12 they have accepted their mistake and has stated that the number of seats allocated to the BC-II category as published in the advertisement no. 02/2023 & 03/2023 is below the requisite numbers. The relevant paragraphs are being reproduced hereinbelow:
“9. That it is most humbly submitted that upon receiving due approval of the Secretary, the Department of School Education and Literacy, the Director, Secondary Education, vide Letter No. 139 dated 21.02.2026, has constituted a High-Level Committee for the purpose of undertaking detailed scrutiny of records and reservation categories of Post Graduate Trained Teachers working as on the date of roster clearance of PGTTCE-2023. That the said High level Committee is headed by the Additional Secretary, Department of School Education and Literacy, and comprises of members from the Department along with officers of the Secondary Directorate. 10.

That it is most humbly and respectfully submitted that it has been found that a computational error may have occurred in the roster clearance calculation, resulting in an inaccurate determination of vacancies. Consequently, the number of seats allocated to the BC-II category was published in a quantity below the requisite numbers. 12.
That it is most humbly submitted that the shortfall in the seats reserved for the BC-II, SC, and ST categories under Advertisement Nos. 02/2023 and 03/2023 ought to be filled by candidates from the respective categories, strictly adhering to the inter-se merit and in accordance with the post-based reservation.”

In light of the aforesaid submissions made by the respondent State, the petitioners humbly submit before this Court to dispose of the writ petitions with the direction upon the respondent State to consider the petitioners for appointment to the remaining posts on the basis of their inter-se-merit. 10. Having regard to the fair submission and the averments made by the respondent-State, interest of justice would be sufficed by disposing of all these writ applications with a direction to the respondent-State to consider these

petitioners for appointment to the remaining posts on the basis of their inter-se merit. 11. Though, it has been contended by Ld. Sr. Counsel for the petitioner that the same should be restricted to the petitioners in the light of judgment passed in the case of State of Uttar Pradesh & Ors. vs Arvind Kumar Srivastava reported in (2015) 1 SCC 347; wherein at para 22.2 the Hon’ble Apex Court has held as under:-
“22.2. However, this principle is subject to well recognized exceptions in the form of laches and delays as well as acquiescence. Those persons who did not challenge the wrongful action in their cases and acquiesced into the same and woke up after long delay only because of the reason that their counterparts who had approached the court earlier in time succeeded in their efforts, then such employees cannot claim that the benefit of the
judgment rendered in the case of similarly situated persons be extended to them. They would be treated as fence-sitters and laches and delays, and/or the acquiescence, would be a valid ground to dismiss their claim.”
12. However, this particular prayer is not acceded by this Court and the respondents are directed to consider this aspect while taking into consideration the appointment to the remaining posts as mentioned in para 10 of the supplementary counter affidavit from among the eligible candidates.
13. The petitioners are given liberty to make detailed representation before the respondent no. 4 within 6 weeks and the respondent nos. 3 and 4 are directed to take a final decision on the matter of appointment of the petitioners and

all other eligible candidates within 8 weeks from the date of receipt of the representation filed by the individual petitioners and other candidates, if any.
14. If one or the other petitioners are found eligible and suitable for appointment, the respondents are further
directed to pass necessary orders and make offer of appointment in favour of the respective petitioners without any further delay.
15. Accordingly, all these writs application stands allowed and disposed of. Pending I.A.s, if any, also stands closed. No cost.
