By this application filed under Section 430(1) of the BNSS, 2023, the applicant has prayed for suspension of sentence in connection with the judgment and order dated 29.07.2026 passed by the learned Sessions Judge, Nalbari in Sessions Case No. 36/2022 and for allowing him to go on bail. By the said judgment and order, the applicant was convicted under Section 447 read with Section 325 of the IPC and was sentenced to undergo simple imprisonment for a period of 2 months under Section 447 IPC with fine and default stipulation as well as to undergo simple imprisonment for a period of 2 years with fine and default stipulation. 3. The sentences were directed to run concurrently. 4. Under Section 430(1) of the BNSS, 2023, the learned Trial Court had allowed the convicted accused person to remain on previous bail till he files the appeal before the Hon'ble Gauhati High Court. It is noticed that the applicant was sentenced to undergo simple imprisonment for 2 years with fine and default stipulation and it is very unlikely that his appeal will be disposed within the said period of time. It is as such directed that the judgment and order dated Page No.# 3/3 29.07.2026 passed by the learned Sessions Judge, Nalbari be remained suspended till the disposal of the criminal appeal. 5. The applicant is further allowed to remain on previous bail till the appeal is disposed of. 6. I.A. is disposed of. JUDGE Comparing Assistant
