The petitioners have filed this petition praying for following relief:- “It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this Petition and set aside/Quash the impugned FIR No. 87/2024 dated 06.06.2024 by the police of Police Station - Basantpur District- Balrampur-Ramanujganj (CG) on the written information made by the complainant Sitaram Agrawal and Others for the offence punishable under s. 420, 467, 468 and 471 and 34 of IPC as well as the Charge- sheet dated 13.08.2025 which after completion of investigation the concerned police has submitted before the learned Judicial Magistrate First Class, Wadraf-Nagar, Balrampur (CG) and on the basis of which the learned Judicial Magistrate First Class, Wadraf-Nagar, Balrampur (CG) registered the case against the petitioner as Criminal Case No. 592/2025 on 09.10.2025 which is an order taking cognizance, in the interest of justice.” 3. Learned counsel for the respondent / State submits that the present petition is a defective one as the complainant of the case i.e. Ravel Kumar, Patwari Halka No.04 who lodged the FIR on the order of Court of Tahsildar, Wadrafnagar, has not been arrayed as party respondent in the case, to which, learned counsel for the petitioner submits that the FIR has been registered by the State itself, i.e. Police Station- Basantpur, District- Basantpur- Ramanujganj and further, the same has been arrayed as the 3 party-respondent. 4. Perusal of the FIR goes to show that the same was lodged on the complaint made by the complainant Ravel Kumar and he has not been arrayed as a party respondent. 5. In view of the same, learned counsel for the petitioners pray to withdraw the present petition with liberty to file afresh. 6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs. 2,000/- as cost by the petitioners in the Registry of this Court and the same shall be transmitted to the Government Home for Mentally Underdeveloped Children, Mana Camp, District- Raipur (C.G.), for wasting the precious time of this Court. 7. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioners after obtaining the photocopy of the same, subject to deposit of the fine amount.
