This writ petition has been filed for the following reliefs: - “for quashing the order dated 8.8.2003 (Annexure-1) passed by the Commissioner, Santhal Parganas Division, Dumka (Respondent No.2) in R.M.R. No. 82/84-85 (Annexure-1) upholding the order dated 29.5.1984 (Annexure-2) passed by the Settlement Officer, Santhal Parganas, Dumka (Respondent no.3) in Tanaza Appeal No. 1/83 affirming the order dated 13.10.82 (Annexure-3) passed by the Assistant Settlement Officer (Respondent No.4) in Tasdik Tanaja Case No. 1 of Mauza Jawari No. 42, P.S. Ramgarh, District Dumka. By the aforesaid orders the claim of the petitioner over the half of the lands of J.B.No. 21 of Mauza Jawari No. 42 P.S. Ramgarh, District Dumka on the basis of being the adopted son of one of the recorded tenants, namely, Hernarain Bhagat stood rejected.” 3. The learned senior counsel for the petitioners has submitted that the matter revolves around legality and validity of adoption of Ramdhani Bhagat by Hernarain Bhagat. He submits that the aforesaid point was subject-matter of consideration in S.A. No. 204/2007 arising out of Title Suit No. 70/1974 and the said Second Appeal No. 204 of 2007 has been remanded to the learned 1st appellate court vide order dated 27.01.2026. The learned senior counsel has also submitted that the Second Appeal was filed by Ramdhani Bhagat, who is the original writ petitioner even before this Court. 4. The learned counsels for the parties jointly submitted that ultimately the issue arising in this case will also get settled once the point regarding adoption of Ramdhani Bhagat by Hernarain Bhagat is settled. The learned counsels jointly submitted that there is no point keeping this writ petition pending. It may be observed that the parties may take appropriate steps depending upon the final outcome of the matter regarding adoption which is now pending before the learned 1st appellate court on account of remand order passed in 2nd appeal. 2026:JHHC:3444 4 5. Considering the submissions and with the consent of the learned counsels for the parties, this writ petition is disposed of observing that the parties may take appropriate steps once the matter regarding adoption of Ramdhani Bhagat (the original petitioner of this case) is ultimately settled in the proceeding arising out of Title Suit No. 70/1974 which is now pending before the learned 1st appellate court. 6.
