This petition has been preferred by the petitioner under Section 528 of BNSS, 2023 seeking direction to direct the Registry for returning of the original documents filed in the CRMP No. 248/2026. 2. Learned counsel for the petitioner submits that the HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2026.02.24 17:13:03 +0530 2 petitioner is a convicted prisoner suffering from mouth cancer, a life-threatening ailment, and is entitled to proper and effective medical treatment. The petitioner approached this Hon’ble Court under compelling circumstances and with bona fide intention, and during the hearing dated 02.02.2026, sought permission to withdraw the petition i.e. CRMP No. 248/2026, with liberty to approach the concerned District Magistrate, which liberty has been graciously granted by this Court. He further submits that the liberty granted by this Court would be rendered illusory and ineffective unless the petitioner is provided with the original medical documents, which are necessary for placing before the competent authority for appropriate consideration. As such, the petition may be allowed, and the original documents filed by the petitioner in CRMP No. 248/2026 may be returned to him in the interest of justice. 3. Learned State counsel has no objection to this proposition put forth by the counsel for the petitioner. 4. I have heard learned counsel for the parties and perused the material. 5. Considering the facts and circumstances of the case, the petition is allowed. The Registry is directed to return the required/original documents filed by the petitioner in CRMP No. 248/2026 to the counsel for the petitioner, after retaining a photocopy of the same. 6.
