The petitioners are apprehending their arrest in connection with Complaint Case No.163 of 2021, for offence registered under section 33(1)(C) of Indian Forest Act, pending in court of learned Chief Judicial Magistrate, Chatra. 3. Learned counsel for the petitioners submits that the false allegations are made against the petitioners of cultivation of poppy plant in the forest land and the petitioners are having no criminal antecedent as disclosed in paragraph no.14. He also submits that the land is not belonging to these petitioners. 4. Learned State counsel opposes prayer and submits that the cultivation of poppy plant in the forest land is there. 5. Considering that the land is of the forest department and the said land is not belonging to the petitioners, and in that view of the matter, both the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release both the petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
