The present petition has been filed by the petitioner under Section 482 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) seeking grant of anticipatory bail in FIR No. 251/2026 registered at Police Station Palam Village, South-West Delhi, under Sections 115(2)/126(2)/140(3)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’). 3. Learned APP for the State has handed over a status report in the Court today. Let the same be taken on record. 4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and merely on the basis of the disclosure statement of a co- accused, he cannot be arrested and is entitled to anticipatory bail. Per contra, learned APP for the State submits that it was a random incident, as is clear from the statement of the complainant. He submits that while the complainant was travelling on his motorcycle, he saw the accused persons travelling in a car hit a dog. When he asked them to drive carefully, two accused persons, namely, Minda @ Ankit and Deepanshu, along with two other persons, got down from the car, while two persons remained inside. Thereafter, they took the complainant to DDA Park, Mangalpuri and thereafter to an isolated agricultural area at Kheda Dabar Village, situated around 31 kilometres from the place of the initial scene of crime, where they brutally assaulted him. 6. Learned APP for the State further submits that it is a random incident and that such incidents should not be allowed on the roads of Delhi. The complainant had merely objected to the manner in which the accused persons were driving the car, for which he was beaten black and blue. He further submits that co-accused Minda @ Ankit, who is named in the FIR, was arrested by the police and, during interrogation, disclosed the entire sequence of events. 7. Learned counsel for the petitioner submits that the co-accused, Ankit, has already been released on bail and recovery has been effected from him. He further submits that even in the MLC, the petitioner's name does not find mention and his custodial interrogation is also not required. Learned counsel for the petitioner further submits that the MLC is of someone else and the complainant is someone else. 8. Keeping in view the nature and gravity of the allegations and the manner in which the offence is alleged to have been committed, this Court is not inclined to grant anticipatory bail to the petitioner.
