02 /10.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 310(2) of the Bharatiya Nyaya Sanhita.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. Learned APP opposes the prayer for bail.
4. From the impugned order, I find that the allegation is against one Sikandar Turi and the looted motorcycle was also recovered near the house of Sikandar Turi. Further the name of the petitioner transpired only on the statement of Sikandar Turi and Sikandar Turi has already been enlarged on bail.
5. The petitioner is in custody since 22.12.2025.
6. Considering the fact that the motorcycle was not recovered from the possession of the petitioner and his name transpires from the confessional statement of co-accused who has already been enlarged on bail, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Giridih in
