B) Consequently to declare that the petitioner is entitled for promotion and to direct the respondents to forthwith consider the case of the petitioner for promotion to the post of Gr. This Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in not considering the genuine claim of the petitioner for promotion to the post of Gr-I Hostel Welfare Officer, even though he is fully eligible, qualified within the zone of consideration and senior most, as illegal and arbitrary. 2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. 3. The case of the petitioner is that the Petitioner is presently working as Hostel Welfare Officer, Grade-II in B. C Welfare Department. However, without any valid reasons, the name of the petitioner is not considered despite of availability vacancies. He submits that even though no departmental proceedings and other proceedings are pending against the petitioner he is not being considered for the promotion. The petitioner has submitted his representation dated 09.07.2025, but the same was not considered by the respondents. Hence, the writ petition. 4 4. Learned Assistant Government Pleader for the Respondents would submit that the representation of the Petitioner would be considered by the Respondents and appropriate orders will be passed as per law. 5. Recording the submissions of learned Government Pleader for the Respondents, the Writ Petition is disposed of, directing the Respondents to consider the representation of the Petitioner dated 09.07.2025 and pass appropriate orders in accordance with law, within a period of eight (08) weeks from the date of receipt of a copy of this order. No costs.
