Ms. Sneh Bhimta, learned counsel and Mr.Baldev Singh Negi, Additional Advocate General, appear and waive service of notice on behalf of respondents No.1 & 2 and respondent No.3, respectively. The instant application has been filed for condonation of 84 days delay in filing the present appeal. It has been averred in the application that the impugned judgment was passed by learned District Judge on 11.09.2025. The applicant applied for certified copy of impugned judgment and the same was delivered on 08.10.2025. When the applicant went to the learned counsel, he was advised to challenge the impugned judgment before this court by filing the appeal. The applicant came to Shimla and contacted his counsel in the second week of December 2025 and requested him to go through the impugned judgment. The applicant after arranging money and obtaining the entire record, again visited the learned counsel and requested him to file the instant appeal. Therefore, it has been prayed that the delay in filing the appeal is neither intentional nor willful, but the same has occurred due to unavoidable circumstances. Learned counsel for the non-applicants have no objection in case the application is allowed. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view of submissions as made by learned counsel for the applicant, the present application is allowed and delay in filing the appeal is condoned.
