JUSTICE S SUNIL DUTT YADAV ORAL ORDER The present petition has been filed seeking for issuance of writ of mandamus to direct respondent No.3 to consider the representations dated 20.09.2024 and 05.02.2025 at Annexures-F1 and F2 and direct them not to disburse the compensation with respect to the lands in question. Further direction is sought in alternative to direct the respondent - authority to deposit the compensation amount in O.S.No.646/2024 which is stated to be pending of the file of Additional Senior Civil Judge and JMFC, Doddaballapura. 2. It is the case of the petitioner that O.S.No.646/2024 filed seeking for a judgment and decree - 4 - HC-KAR NC: 2026:KHC:14072 WP No. 25239 of 2025 of partition and for carving out of 1/4th share in the property in old Survey No.123, new Survey No.123/P17 measuring 1 acre 15 guntas is pending consideration before the Additional Senior Civil Judge and JMFC, Doddaballapura in which proceedings, the petitioner as well as respondents No.4 to 6 are parties. It is accordingly submitted that in light of pendency of dispute between the private parties, the respondent - Karnataka Industrial Areas Development Board (KIADB) may be restrained from disbursing compensation till such proceedings are finally adjudicated. 3. Learned counsel Sri. H.L. Pradeep Kumar appearing for the respondent - KIADB submits that in light of the admitted litigation between the petitioner and respondents No.4 to 6, they would take necessary steps to make reference under Sections 30 and 31 of the Land Acquisition Act, 1894. - 5 - HC-KAR NC: 2026:KHC:14072 WP No. 25239 of 2025 4. In light of said stand of the respondent - KIADB, petition is disposed of. It is made clear that till reference is made, as undertaken by the respondent - KIADB, compensation amount not to be disbursed. 5. Learned counsel for the respondent - KIADB further submits that he has no complete instructions as to whether reference is already made or not. 6. Needless to state, the direction would also hold good regarding non-disbursal of the compensation, if reference is already made. If reference is not made, necessary steps to be taken to make reference. 7. Accordingly, petition is disposed of. 8. Compliance of office objections is waived, in light of disposal of the petition.
