The case of the petitioner in brief is that he is engaged in the business of supplying plants and trees of various kinds. That he was issued a supply order by respondent No.3 i.e. BDO Mandi, District Poonch for supply of 32,300 fruit plants, which he supplied against proper acknowledgement. That the plants, supplied by him to the respondent No.3, subsequently came to be handed over to each panchayat in the concerned block against proper receipts. That the rate prescribed for each plant was Rs.60/- as per government approved rate. That despite providing 32,300 fruit plants as per the supply order, the respondents till date have not released the due payment in his favour. That he made various representations before the respondents for release of his due payment but they did not pay any heed to his genuine request whereupon he was prompted to approach this Court through medium of this petition. Sr. No. 102 2 WP(C) No. 1559/2026 [ 3. The petitioner has accordingly sought issuance of the direction/writ for directing the respondents to release the pending due amount in his favour. 4. In the facts and circumstances of the case, this Court is of the opinion that the matter can be disposed of even at this threshold stage by passing of appropriate directions which are not likely to prejudice the interest of the respondents. 5. Accordingly, the instant petition is disposed of with the direction to the respondents that they shall verify the matter and pay the amount due to the petitioner on account of supply of plants by him against a proper supply order within a period of four weeks’ from the receipt of the copy of this order.
