ORAL ORDER This Court had disposed of WP.No.27964/2023 dated 11.06.2022 by allowing writ petition in part and maintenance to the 2nd son was enhanced from an amount of Rs.5,000/- to Rs.10,000/- and the amount shall be paid by 5th of every succeeding month and the wife was not entitled for any maintenance. Against the said order review petition is filed seeking review of the order dated 11.06.2022.
2. Both the parties are referred to as mother and father for the sake of convenience.
3. Learned counsel appearing for the petitioner/mother submits that though the petitioner is an advocate, she has recently completed her LLB and she is a junior advocate and she is not having enough income to support herself and this aspect is not considered by this Court. Further considering the financial capacity of the husband, the Court ought to have granted reasonable amount for the welfare of the child. The respondent/husband is having several properties and the 1st son is studying abroad and the 2nd son also requires to be

maintained in the same standard. It is submitted that the 2nd son is studying in 6th standard now and the petitioner/mother is not having sufficient income to support herself and the son. She is not employed since 2015 and she completed LLB in the year 2020 and later she joined the profession and working with a Senior Advocate and whatever the amount she is earning is not sufficient to maintain herself and the child. All these aspects were not considered by this Court while passing the
order whereby it is held that the wife is not entitled for maintenance and only an amount of Rs.10,000/- is awarded to son. It is submitted that the MC is filed by the husband seeking divorce. In the MC proceedings he has denied the paternity of the 2nd child and the DNA test was conducted. As per the report the respondent/father is the biological father of the child. It is submitted that all these facts clearly shows that the intention of the father is only to get the divorce and not to pay the maintenance to the wife and the child. 4. When the review petition is filed, this Court has tried to conciliate the matter between the parties and has interacted with the parties in the chamber. On 05.12.2025, this Court referred to the DNA report and also considering the submission

that there is a likelihood of settlement between the parties and they will meet in the respondent’s Advocate office on 08.12.2025 had adjourned the matter to 10.12.2025 and also observed that by that time if the compromise talks works out the same shall be reported to this Court, this Court underwent several adjournments in the couple of occasions. The order 17.12.2025 discloses that the Court has interacted with both the parties. The husband submits that he is ready to pay an amount Rs.1,00,00,000/- as a final settlement to the wife as well as to the 2nd child. According to the wife, the husband is having lot of properties and he has suppressed several facts before this Court and she requires an amount of Rs.3,00,00,000/- as full and final settlement excluding the amount that is lying in the banks at New Zealand and the husband submits that he will not be able to pay the amount. Accordingly the matter was directed to be listed after the winter vacation 2025. On 31.01.2026, the learned counsel appearing for the wife submitted that the wife is ready for a full and final settlement by taking the permanent alimony of Rs.1.00 Crore to herself and Rs.1.00 Crore to the 2nd son who is 11 years old.
This Court has observed that on the last occasion

respondent/father had submitted that he will pay the entire educational and other expenses of the 2nd child who is staying with the mother and give him the same standard of living and education as he has provided to the 1st son. Hence the matter was adjourned to get specific instructions in this regard. 5. Today when the matter came up and learned counsel appearing for the respondent submits that the said proposal is not acceptable to the father. Further it is submitted that the Court having considered the respective contentions of both the parties had rejected the case of the wife for grant of maintenance and there are no grounds made out for reviewing the order. It is submitted that the wife is practicing from 2022, she is having sufficient means to maintain herself. All these aspects were not placed before the Court. It is submitted that the husband is incurring substantial amount for the education of the 1st child. In these circumstances the wife is not entitled for the maintenance. The review of the order dated 11.06.2024 is not required and no grounds are made out to review the
order.

6. Having heard the learned counsel on either side, perused the entire material on record. The respondent/father had filed the MC seeking divorce. It is the specific stand of the husband that he is not the biological father of the 2nd child and in the light of that was subjected to the DNA test. The DNA test result shows that he is the biological father of the child. When this matter came up before the DNA report, it is vehemently contented that the paternity of the 2nd child is in dispute. During the conciliation before the Court, the husband was ready to pay an amount of Rs.1,00,00,000/- to the wife and the entire educational expenses of the 2nd child. In the light of the statement that is made before this Court, this Court need not go into the aspect about the financial capacity of the husband. The husband is financially capable to maintain the child and take care of all the expenses. In the order that is under review, this Court had enhanced maintenance from Rs.5,000/- to Rs.10,000/-. This Court is convinced by the
arguments that is advanced on behalf of the counsel for the mother that she is not in a position to maintain herself. She is enrolled as an advocate in the year 2022 and she has not been working from 15 years and it is a fact that before 2015 both the

parties were in New Zealand and in the light of the disputes between the parties and the fact that mother was not working and as far as the husband's financial capacity is concerned it is not disputed. The 2nd child also requires the same kind of education and treatment as the first child is having from the father. As far as the wife is concerned, the MC is pending and the fact that she is still working as a Junior Advocate and she has to take care of herself and the 2nd child, this Court deems it appropriate to modify the order passed in WP.No.27964/2023 dated 11.06.2024.
In W.P.20087/2025:
7. WP No. 20087/2025 is filed questioning an order that is passed by the Court rejecting the application of the mother seeking educational expenses in MC.No.1838/2015. In the light of the orders passed by this Court in WP.No.27964/2023, as this Court has already considered the case of the child's educational expenses and passed an order nothing remains to be adjudicated in this writ petition. Hence, this Court is passing the following:

ORDER
i. The
order passed in WP.No.27964/2023 dated 11.06.2024 by this Court is modified. ii. The husband/father shall take care of the entire educational expenses of the 2nd child. iii. Husband shall pay an amount of Rs.40,000/- per month towards the maintenance of the wife and also towards the maintenance of the child from the date of the petition filed for maintenance. iv. The
order passed in M.C.No.1838/2015 dated 13.06.2025 by the 5th Addl. Principal Judge, Family Court, Bangalore is set aside. v. If the husband pays the arrears of maintenance, the Family Court shall expedite the hearing of the pending MC. vi. Accordingly, RP.No.283/2024 is disposed of. vii. Accordingly, the WP.No.20087/2025 is disposed of. i. All pending I.As. in the writ petition shall stand closed.
