The petitioner is apprehending her arrest in connection with Katkamsandi P.S. Case No. 125 of 2025, registered for the offence under Sections 123, 125(b), 109, 61(2), 62 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Hazaribag. 3. Learned counsel appearing for the petitioner submits that the petitioner is the wife of the informant and she has been falsely implicated in this case. She next submits that the petitioner has not served the food along with mixing the poison. On this ground, she submits that the privilege of anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State and learned counsel appearing for the informant jointly opposed the prayer and submit that the independent witness has also supported the case and the altercation took place for a piece of land and even she was not residing along with her husband and she was residing with another person. 5. In view of the above, it appears that there is direct allegation against the petitioner of serving poisonous food to her [2026:JHHC:3869] -2- husband and for that the husband was treated in the hospital from 07.05.2025 to 12.5.2025 and independent witness in the case diary has also supported the prosecution case. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail is rejected.
