[2026:RJ-JP:32226] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Miscellaneous Application No. 109/2026 In S.B. Civil Transfer Application No.105/2025 CNR: RJHC020291582026 | URN: CMAP / 146U / 2026 Harishankar Sharma S/o Chandrabhan Sharma, Aged About 76 Years, R/o Padam Villa, Plot No. 37, Vivek Vihar, New Sanganer Road, Jaipur, Rajasthan. ----Applicant/Petitioner Versus Uma Sharma W/o Harishankar Sharma, Aged About 67 Years, R/o Padam Villa, Plot No. 37, Vivek Vihar, New Sanganer Road, Jaipur, Rajasthan. ----Respondent For Petitioner(s) : Mr. M. M. Ranjan, Sr. Adv. For Respondent(s) : HON'BLE MR. JUSTICE MANEESH SHARMA Order 14/08/2026 1. The present Civil Miscellaneous Application has been preferred by the applicant/petitioner seeking an appropriate direction in Transfer Petition No. 105/2025, which was disposed of vide order dated 05.05.2025 passed by this Court. 2. Learned counsel for the applicant/petitioner submits that the applicant/petitioner is a senior citizen and is suffering from a critical medical condition. He, therefore, prays that, considering the age of the applicant/petitioner and the prolonged pendency of the case, an order transferring the case from the Civil Court to the Family Court is necessary. 3. Heard and considered the submissions made by learned counsel for the petitioner and perused the record. [2026:RJ-JP:32226] (2 of 2) [CMAP-109/2026] 4. From a perusal of the record, it is borne out that the applicant had filed Transfer Application No. 105/2025 with the following prayer: " It is therefore prayed that your lordship may graciously be pleased to accept this transfer application and further be pleased to transfer Civil Suit No. 201/2010 pending before court Additional District And Session Judge No. 06, Jaipur Metropolitan II titling Harishankar Sharma v/s Uma Sharma to family court No.1 Jaipur; and the Family Court Jaipur may be directed to hear the final arguments and pass Judgement on merits. Any other relief in favour of the Plaintiff/Petitioner just and equitable in the circumstances of the case may also be passed" 5. The said Transfer Application and the relief sought therein (reproduced above) were considered and disposed of by this Court vide order dated 05.05.2025. 6. A perusal of the present Civil Miscellaneous Application reveals that the applicant has re-agitated the same relief as sought in the Transfer Application which has already been disposed of by this Court on 05.05.2025. Therefore, I neither find any good reason to grant the relief sought for, nor do I find any valid ground made out to entertain the present Civil Miscellaneous Application. 7. Accordingly, the present Civil Miscellaneous Application is hereby dismissed, with liberty to the applicant/petitioner to file a fresh transfer application narrating his recent or subsequent concerns and hardships. 8. As a necessary corollary, all pending application(s), if any, shall stand disposed of. (MANEESH SHARMA),J 27/Seema
