CORAM:
HON'BLE MS. JUSTICE MADHU JAIN O R D E R % 29.07.2026
1. This hearing has been done through hybrid mode.
2. These are bail applications under Section 483(1) read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking grant of regular bail in FIR No. 044/2026 dated 24.02.2026, registered under Sections 105 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 at Police Station- Pul Prahladpur.
3.
Learned counsel for the applicants submits that even in the subsequent third medical opinion rendered by the Medical Board, the cause of death has been opined to be coronary artery disease. 4. Learned APP, as well as learned counsel for the complainant, submits that the applicants were fully aware of the pre-existing heart condition of the deceased. Despite such knowledge, they continuously assaulted the deceased, who was 62 years of age. 5. They further submit that, even as per the medical opinion, the estimated duration between the infliction of injuries and the time of death is around 3 to 5 days. It is further submitted that, even prior to the incident dated 23.02.2026, another incident had taken place on 18.02.2026, wherein the CCTV footage allegedly shows all three applicants beating the deceased. It is, therefore, This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. submitted that the estimated duration of 3 to 5 days, as mentioned in the MLC, is on account of both the incidents. 6. He further submits that both the parties are residing in close proximity to each other and, if released on bail, there are high chances that the applicants may intimidate the witnesses. 7. Heard learned counsel for the parties. 8. The incident in question took place on 23.02.2026. Even prior thereto, another incident had taken place between the parties on 18.02.2026, in respect of which a written complaint was made to the concerned police station; however, no FIR was registered. 9. It also appears that there has been a long history of litigation between the parties, as several cases have been filed by both sides against each other prior to the present case. 10. Both the parties have been involved in a dispute over a piece of land for the last 3–4 years, and even the incident forming the subject matter of the present FIR appears to have taken place on account of the said dispute. 11. However, it cannot be overlooked that the complainants have lost a family member in the incident dated 23.02.2026. The medical opinion, however, records that the cause of death was coronary artery disease and not the injuries sustained by the deceased.
It has been specifically opined that the injuries, individually or collectively, were not sufficient to cause death in the ordinary course of nature. The death appears to have resulted from the pre- existing heart condition of the deceased, which may have been aggravated by the quarrel or the injuries sustained during the incident. 12. In these circumstances, considering that the charge-sheet has already been filed, though the supplementary charge-sheet is yet to be filed, and no This is a digitally signed order.
