HON'BLE MR. JUSTICE MANEESH SHARMA Order 11/08/2026
1. The present revision petition has been filed by the petitioner on 07.02.2020, assailing the orders dated 07.11.2019 passed by learned District Judge, Jaipur in Civil Miscellaneous Appeal No.8/2019 titled as 'Mahesh Kumar Dubey Vs. Smt. Nand Kanwar & Ors.', whereby the appeal under Order 43 Rule 1 of CPC filed against the order dated 24.04.2019 passed by learned Additional Senior Civil Judge No.2, Jaipur District, Jaipur in Civil Miscellaneous Application No.5/2018 titled as 'Mahesh Kumar Dubey Vs. Smt. Nand Kanwar & Ors.', whereby the application under Order 9 Rule 13 of CPC was dismissed. [2026:RJ-JP:31589] (2 of 2) [CR-31/2020]
2. No one has put in appearance on behalf of the petitioner. 3. From a bare perusal of the order-sheets, it is reflected that upon filing of the petition, till now, the office has pointed out certain defects. It is also evident that defects Nos. 3 and 4 have not been removed by the petitioner. 4. On 25.07.2023, the following order was passed by a Co- ordinate Bench of this Court, which reads as under:
"Learned counsel for the petitioner prays for a week's time to remove the defects. Defects have not been removed for last more than three years and four months despite opportunity. However, in the interest of justice, the petitioner is granted a week's time to remove the defects failing which the civil revision petition shall stand dismissed without reference to the Court."
5. Thereafter, the matter was dismissed for non-compliance. Subsequently, the matter was restored by an order dated 16.10.2025 passed by a Co-ordinate Bench of this Court. However, even thereafter, the defect(s) pointed out by the Registry have not been removed. 6.
Thus, from the foregoing discussion, it is evident that the petitioner herein has lost interest in pursuing the present matter. 7. In view of the above, the present civil revision petition is dismissed for want of prosecution. 8. All pending applications, if any, stand disposed of. (MANEESH SHARMA),J 144/Seema
