The petitioner has filed the present petition as a public interest litigation, inter alia, praying as under: (i) A writ of mandamus or any other order/direction directing the respondent No.1 to 8 not to grant the license for conducting the gravel crusher to the respondent No.9 and 10 in Sy.No.60 of S Agrahara between Mathnahalli and S Agrahara Village, Sugaturu Hobli, Kolar Taluk and Sy.52 of Irasandra village, Vemgal Hobli, Kolar Taluk, (ii) A writ of Mandamus or any other writ directing the respondent No.9 and 10 to stop the crusher activity in the land Sy.No.60 of S Agrahara Village between Mathnahalli and S Agrahara Village, Sugaturu Hobli, Kolar Taluk and Sy.No.52 of Irasandra Village Vemgal Hobli, Kolar Taluk,

(iii) Pass such other writ or order or direction that this Hon'ble Court may deem fit and proper on facts and circumstances of the case in the interest of justice and equity. 2. The petitioner states that he is a resident and a member of Sugaturu Grama Panchayath. He has filed the present petition in respect of stone crushing activities proposed to be carried on in land comprising Survey No.60 of S.Agrahara Village between S.Agrahara and Mathnahalli village, Sugaturu Hobli, Kolar Taluk and Survey No.52 of Irasandra village, Vemagal Hobli, Kolar Taluk. 3. The petitioner states that although the license has not been granted as yet, the villagers have made a representation opposing the grant of license, as it would adversely affect the surrounding areas and their agricultural activities. 4. Although the averments made in the petition reads as if the stone crushing activities have started, the learned counsel for the petitioner clarifies that no such activity has commenced as yet. In view of the said clarification, the prayer that directions be issued to respondent No.9 and 10 to stop the crushing activities is not maintainable. - 5 -

Since it is stated that the villagers have made a representation opposing the grant of license for carrying on stone crushing activities on the subject lands, there is no reason to doubt that the said representation would be given the consideration it deserves by the concerned authorities.
