This civil petition is filed by the wife seeking transfer of M.C.No.9/2026, which was filed by the husband before the Senior Civil Judge and JMFC at Huvinahadagali. It seems that the case was subsequently made over to the Court of Senior Civil Judge and JMFC at Hagaribommanahalli. The wife has requested that the said case be transferred to the Court of Senior Civil Judge and JMFC at Jagaluru. The distance between Jagaluru and Hagaribommanahalli is 69 kilometres. It is stated that the petitioner is not working and earning. She is currently residing with her mother and after the marriage, the parties lived together only for two months and the - 3 - HC-KAR NC: 2026:KHC:20585 CP No. 85 of 2026 petitioner has been residing with her parents since February 2025. 3. Learned counsel for the respondent stated that the respondent is required to take care of his parents and is residing at Huvinahadagali. The distance between Huvinahadagali and Hagaribommanahalli is 34 kilometres. It is further stated that the respondent is willing to bear the traveling expenses of the petitioner. The petitioner herein can file her chief affidavit and she can be cross- examined either through a Court Commissioner or by way of video conferencing. Therefore, her personal presence before the Court is not required on every hearing. In cases where her presence is necessary, the respondent shall bear the travelling and accommodation expenses of the petitioner, another person accompanying her. Considering fact that the distance between the two places is not much and the reasons stated by the petitioner seeking transfer of the case are not convincing. The Court of Senior Civil Judge and JMFC, Hagaribommanahalli, is directed not to insist upon the personal appearance of the petitioner unless there is any requirement by the Court.
