1. By way of the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”], the applicant seeks anticipatory bail in connection with FIR No. 13/2025 dated 24.01.2025, registered at Police Station Special Cell, Delhi, for offences punishable under Sections 21/29/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 [“NDPS Act”]. 2. I have heard Mr. Varun Deswal, learned counsel for the applicant and Mr. Tarang Srivastava, learned Additional Public Prosecutor. 3. The FIR arises out of secret information received on 23.01.2025 to the effect that two persons, namely Mitralal @ Manoj and Akash, alongwith a third associate, all stated to be residents of Manipur and allegedly engaged in the supply of heroin, would arrive near the water treatment plant in the Mangolpuri Industrial Area between 6:00 PM and This is a digitally signed order. Acting upon the aforesaid secret information, the raiding team reached the designated location and observed three persons alighting from an e-rickshaw, each carrying a bag. The said persons were apprehended, and upon search, each of them was found to be in possession of a bag containing heroin. They were accordingly arrested on the same day. The recovery comprised 4.002 kg of heroin from Mitralal @ Manoj, 2.997 kg from Krishna, and 2.997 kg from Akash. 5. During the course of interrogation, the arrested accused allegedly disclosed that they had created a secret cavity in a truck bearing registration No. WB-76A-9770, which is stated to belong to the present applicant, for the purpose of transporting contraband. According to their disclosure statements, the consignment was initially intended to be transported by one Bheem, the father of co-accused Akash, in the said truck.
However, as he was ultimately unable to do so, the three accused were allegedly entrusted with the transportation of the contraband. It was further disclosed that, while travelling through Bihar, the said truck broke down and had to be parked on the roadside, whereafter the accused proceeded to Delhi by public transport. 6. During the course of the investigation, it also emerged that the aforesaid truck is registered in the name of Narayan Karki, the husband of the present applicant. 7. Upon technical analysis and voice call interceptions, telephone conversations have been intercepted between the present applicant and Bheem. Mr. Srivastava states that the telephone conversations reveal that This is a digitally signed order. By order dated 06.02.2026, this Court granted the applicant interim protection from arrest, subject to her joining the investigation, while recording, inter alia, as follows:
“Having heard learned counsel for the parties, I am of the view that interim protection maybe granted to the applicant at this stage, subject to her joining investigation. The conversation relied upon by the prosecution did not involve any of the three persons from whom the contraband has been recovered. The conversation between the applicant and Bheem relates to an intention to create a cavity in an unidentified truck. There is no material, at this stage, to show whether any such activity was, in fact, carried out. The truck identified by the co-accused has also not been recovered yet, and the contraband was not seized from the said truck at all.”
9. A status report dated 06.03.2026 has been filed on behalf of the prosecution. 10. Mr.
Srivastava confirms that the applicant has joined the investigation. While he fairly acknowledges that no recovery has been effected from the applicant, he submits that her involvement in the alleged offence is borne out by the intercepted telephonic conversations between her and co-accused Bheem, which, according to the prosecution, indicate their intention to create a concealed cavity in the truck in question. He further confirms that the said truck has not been recovered thus far. 11. It appears from the above that no recovery has been effected from the applicant and that the prosecution has, thus far, been unable to recover the truck in question, so as to ascertain whether a concealed cavity was actually created therein. In such circumstances, prima facie material This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. It is directed that, in the event of the arrest in connection with FIR No. 13/2025 dated 24.01.2025, registered at Police Station Special Cell, Delhi, the applicant shall be released on bail upon furnishing a personal bond in the sum of Rs. 30,000/- with one surety in the like amount, to the satisfaction of the Investigating Officer/Station House Officer, subject to the following conditions: a) The applicant shall join and cooperate with the investigation as and when required by the Investigating Officer; b) The applicant shall furnish her mobile number to the Investigating Officer and ensure that the same remains operational and switched on at all times.
