JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.125/2025 for the offences punishable under Sections 85 and 3(5) of the BNS, 2023 and under Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. Siddappaji S., learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.5934/2025 and have settled the dispute amongst themselves before the Family Court by terms of settlement. One of the term of the settlement is, closure of the present proceedings. The said term in the settlement reads as follows: - 4 - HC-KAR NC: 2026:KHC:8204 CRL.P No. 15521 of 2025 "MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. I. The Petitioner has filed this petition against the Respondent under 13 (1) (1-a) of the Hindu Marriage Act 1955 for dissolution of the marriage. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation the parties along with their respective counsel were present, identified each other and have resolved their dispute and have agreed to the following terms and conditions: 1. The petitioner and the respondent are Hindus by religion. Their marriage was solemnized on 19.11.2023 at Sri. Y.Muniswamappa Kalyana Mantapa, Near Yeshwanthpur Bus Stand, Bengaluru 560 021 as per Hindu rites and customs. 2. The parties state and admit that due to irreconcilable differences and incompatibility of temperaments, they are living separately from 14th September 2025. The efforts made by the elders, friends and well wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of a reunion between them. The petitioner and the respondent know that their marriage is irretrievably broken down and there are no chances of reunion to lead a happy married life. Hence, the petitioner and the respondent have decided to get the marriage dissolved by a decree of divorce. 3. The Petitioner and the Respondent state that they have no children born to them from their marriage. 4. The petitioner has agreed to pay a sum of Rs.6,00,000/- (Rupees Six Lakhs Only) to the respondent towards all her claims of maintenance / permanent alimony as full and final settlement by way of Demand Draft bearing No. 785862 dated 19.01.2026 drawn on State Bank of India, Gayathrinagar Branch, Bengaluru and the same will be handed over to the respondent before the Hon'ble Court at the time of reporting settlement for which the respondent has agreed. - 5 - HC-KAR NC: 2026:KHC:8204 CRL.P No. 15521 of 2025 5. Both the parties state that they have already exchanged their valuable articles and other personal belongings as such they have no claims in this regard. 6. The parties herein state that they have no claims over the movables/immovable's belonging to each other at present or to be acquired in future in view of this agreement. 7. The Petitioner and the Respondent apart from the above they have no claims, of any nature whatsoever, against each other, whether past, present or in future. 8. The Respondent has agreed to co-operate with the Petitioner to quash the FIR No. 125/2025 which is lodged by the Respondent against the Petitioner and his family members for the offence punishable under section 498A, 34, 35 of IPC R/w Section 3 & 4 of D.P.Act before the North Women Police station, Bengaluru, in this regard the Petitioner has filed a Crl.P.No.15521/2025 before the Hon'ble High Court of Karnataka, Bengaluru for quashing the FIR No.125/2025. 9. The Petitioner filed a criminal complaint against the Respondent and her family members before the Subramanyanagar Police Station, Bengaluru. In view of this agreement the Petitioner has agreed not press the said complaint. 10. Both the Parties admit and agree that there is no collusion or force, fraud and undue influence in agreeing/ settling the aforesaid terms and conditions and entering into this Agreement in the aforesaid manner. 11. Both the parties state that without pressing on the allegations levelled against each other either orally or expressly arrived at this agreement. 12. Both the parties undertakes to not to interfere in each other's lives in future in any manner or whatsoever. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 19.11.2023 at Sri. Y. Muniswamappa Kalyana Mantapa, Near Yeshwanthpur Bus - 6 - HC-KAR NC: 2026:KHC:8204 CRL.P No. 15521 of 2025 Stand, Bengaluru 560 021 by granting a decree of divorce in terms of this agreement. IV. Parties will appear on 20.01.2026 before the Hon'ble Court for passing of orders in terms of the agreement." 4. Therefore, in light of the settlement arrived at between the parties quoted supra and the offences not being against the State, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.0125/2025 pending before the 32nd Additional Chief Metropolitan Magistrate Court, Bengaluru, stands quashed, qua these petitioners.
