Heard, learned counsel for the petitioner and learned counsel for the State
2. In this case, petitioner’s right, title and interest over the land in question is involved and also the fact as to whether the sale deed which has been executed by the petitioner in favour of father of respondent Nos.6 to 10 and husband of respondent No.5 is valid or not. The petitioner takes a plea that even inspite of registering the sale deed, the sale proceed were not paid to the petitioner. He further submits that an agreement was entered into between the parties that the balance of the consideration amount will be paid but that was not
paid thus, he had executed another deed cancelling the registered sale deed. He further submits that though the registered sale deed was executed but possession was not handed to the purchaser.
3. After hearing the submission of the parties, it is clear that there is dispute in respect of right, title and interest and also the registered sale deed of the land in question. Without a proper declaration on the validity of this registered sale deed, the petitioner cannot get any relief in this case. Whether the petitioner has handed over possession of the land in question to the purchaser or not, is a question of fact, which also cannot be decided in this writ petition.
4. The petitioner thus should approach the appropriate Civil Court praying relief for cancellation of sale deed and for other consequential relief and also claim right, title and interest over the property in question. If such suit is filed, the same will be decided on basis of the evidence adduced during the trial. The Trial Court will not be prejudiced by the order passed by the Revenue Authorities.
5. The mutation of the land in question will be done as per the decree passed by the Civil Court.
6. With the aforesaid observation, the instant writ petition stands
disposed of.
