By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the petitioner seeks quashing of FIR No. 0708/2024, for the offence punishable under Section 109(1) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), registered at Police Station Moti Nagar, Delhi, and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. 4. The Petitioner and Respondent no. 2 are present before this Court and This is a digitally signed order. Brief facts of the case are that the present FIR came to be registered in relation to a dispute between the parties, who are neighbours. Learned counsel for the Petitioner submits that the dispute between the Petitioner and Respondent No. 2 has been amicably settled vide Compromise Deed/MOU- cum-Settlement Agreement dated 24.03.2026. 6. Learned counsel for the Petitioner submits that, in terms of the settlement arrived at between the parties, the total settled amount is Rs.3,00,000/- (Rupees Three Lakhs Only), of which a sum of Rs.1,50,000/- had already been received by Respondent No. 2. He submits that the balance amount of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) has been handed over to Respondent No. 2 today in Court by way of Demand Draft No. 749948. It is further submitted that, with the said payment, the terms and conditions of the settlement stand fully complied with and nothing further remains to be paid by either party under the settlement. 7. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, has categorically stated that he has entered into the settlement vide Compromise Deed/MOU-cum-Settlement Agreement dated 24.03.2026 out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 8. In view of the above, and given that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose would be served by continuing the proceedings; rather, the same would only create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings This is a digitally signed order.
