JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents. 2. Learned Senior counsel Sri.K.N.Phanindra appearing for the petitioners submits that respondent No.2 - Deputy Commissioner, Bengaluru Urban District has issued the impugned notices at Annexure-A series to all the petitioners herein directing them to remove the residential structures put up on their respective agricultural lands, on the ground that the said construction has been made without getting the lands converted and without obtaining the permission from the local authority. Learned Senior counsel submits, while pointing out to the proviso to Sub-Section (1) of Section 95 of the Karnataka Land Revenue Act, 1964 that an owner of agricultural lands is permitted to put up any farm building or farm house to an extent not exceeding 10% of the total extent - 4 - HC-KAR NC: 2026:KHC:10289 WP No. 5276 of 2026 of land. That being the position, without any enquiry as to whether the construction put up by the petitioners exceeds the prescribed 10%, the impugned notices have been issued. Consequently, the writ petition is allowed. The impugned notices at Annexure-A series are hereby quashed and set aside. However, liberty is reserved to respondent No.2 - Deputy Commissioner to verify from a preliminary enquiry as to whether the constructions put up by the petitioners exceed the prescribed limit in terms of the provision of law and if it is found that the construction is in excess of what is permitted, then he may proceed in accordance with law.
