2. The present petition is filed under Section 483 of the BNSS, 2023 for grant of bail to the petitioner in connection with Nazira P.S. Case No. 26/2026 under Section 61(2)/121(2)/109/308(4)/62/324(6) of BNS, 2023 r/w Section 25(1- A)/27 of the Arms Act.
3. The learned counsel for the petitioner has submitted that on another F.I.R lodged regarding the same incident, the petitioner had been granted default bail.
4. The learned Addl. APP has submitted that the petitioner was part of the group of person who has resorted to using illegal arms.
5. I have perused the Case Diary and it is seen that although there are allegations against the other persons of having used Fire Arms, however, considering the length of detention, age of the petitioner and the contents of the Case Diary, I am of the considered opinion that the petitioner may be granted the privilege of bail at this stage since the Case Diary does not reveal his involvement in use of Fire Arms etc.
