By virtue of the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the applicant seeks grant of anticipatory bail in FIR No.290/2026 dated 12.05.2026 registered at PS.: Mundka, Delhi under Sections 74/78/115/126(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2. Briefly put, as per prosecution on 11.05.2026, an altercation ensued between the parties over the issue of water supply pipeline, in the course of which, present applicant along with other co-accused persons namely, Urmila, Monika, Nisha and Divya assaulted the complainant/ respondent no.2, wherein, the applicant also outraged the modesty of the complainant by tearing her suit and pressing her chest. APP and has also perused the materials including the Status Report handed over by the learned APP, which is taken on record. 4. At the outset, this Court notes that although the FIR alleges that the applicant outraged the modesty of the complainant by tearing her clothes and pressing her chest, however, the order dated 09.06.2026 passed by the learned Additional Sessions Judge (SC-RC)-02, West, Tis Hazari Courts, Delhi, while rejecting the applicant’s bail application, categorically records that “… …In the CCTV footage, it is clearly visible that the accused is repeatedly hitting the complainant. Before this hitting of the complainant by the accused, the upper garment of the complainant was already torn and her undergarment i.e. brassier was exposed. The complainant was being beaten by four ladies i.e. co-accused persons. The applicant/accused also joined the said ladies/co-accused persons and hit the complainant…”. 5.
In view thereof, and as all the other offences alleged against the applicant are bailable in nature, as also since the applicant is an elderly citizen, who, as per the Status Report, has joined the investigation and is participating therein, this Court does not see any fetters to grant protection to the applicant by way of an anticipatory bail. 6. Accordingly, the present application is allowed and the applicant is granted anticipatory bail in proceedings arising out of FIR No.290/2026 dated 12.05.2026 registered at PS.: Mundka, Delhi under Sections 74/78/115/126(2)/351(2)/3(5) of the BNS, subject to him joining and participating in the investigation. 7. As such, in case of his arrest, the applicant shall be released, subject to him furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) along with one surety of the like amount by a family This is a digitally signed order. member/ friend having no criminal case pending against him/ her and further subject to the satisfaction of the Arresting Officer/ SHO as also subject to the following conditions:- A. Applicant shall ordinarily reside at the address as mentioned in the Memo of Parties of the present application and shall not leave the same without prior permission of the concerned Court. B. Applicant shall surrender his Passport, if any, to the IO. C. Applicant shall join and participate in the investigation as and when called by the IO. D. Applicant shall provide all his mobile numbers to the IO concerned which shall be kept in working condition at all times. E. Applicant shall not indulge in any criminal activity. F. Applicant shall not contact the complainant or their family members or any other prosecution witnesses with a view of influencing/ winning over them, as also shall not tamper with the evidence of the case. 8.
Accordingly, the present application, along with the pending application, is allowed and disposed of in the aforesaid terms. 9. Copy of this order be sent to the concerned IO/ SHO for information and compliance thereof. 10. The observations expressed hereinabove, if any, being tentative in nature, will not come in the way of any subsequent proceedings, which shall be dealt on their own merits.
