Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 123 of 2018 dated 26.06.2018, registered at Police Station Theog, District Shimla, H.P. for the commission of offences punishable under Sections 341, 323, 382, 504, 506, 427 read with with Section 34 of the Indian Penal Code (IPC) because of the compromise effected between the parties. 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2026:HHC:25421 2. It has been asserted that the matter has been compromised between the parties with the intervention of local friends and relatives of the petitioner and respondents No. 2 to 4. Respondents Nos 2 to 4 do not want to proceed further with the matter after the compromise. Hence, the petition. 3. Statements of the informant, Nidhi Sharma and the victims, Aditi and Sushant Verma, were recorded on 24.04.2026, in which they stated that they had entered into a compromise with the accused voluntarily. They did not want to proceed further with the matter after the compromise and had no objection to quashing the FIR and the proceedings arising out of the FIR based on the compromise. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. The offences punishable under Sections 341, 323, 504, 506 and 427 of the IPC are compoundable under Section 320 of the Cr.PC. This Court has already quashed the FIR registered for the commission of an offence punishable under Section 382 of the IPC in Prashant Dharmani versus State of H.P 2022 (4) Shim. LC 2226 and 3 2026:HHC:25421 Krishan Lal versus State of H.P. 2022 (4) Shim. LC 2347 based on compromise. These judgments are binding on this Court. 6. In view of the binding precedent of this Court, the present petition is allowed and FIR No. 123 of 2018 dated 26.06.2018, registered at Police Station Theog, District Shimla, H.P. for the commission of offences punishable under Sections 341, 323, 382, 504, 506, 427 read with Section 34 of IPC and the consequential proceedings pending/initiated against the petitioner-accused in pursuance thereof are ordered to be quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
