HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 39180 of 2026 Court No. - 2 HON'BLE J.J. MUNIR, J.
HON'BLE VIVEK SARAN, J.
1. Since the fact whether the petitioner executed the boring work as a subject of civil contract between the parties is disputed according to the written instructions produced by the learned Standing Counsel before us from the Superintending Engineer, Minor Irrigation Circle, Meerut dated 01.10.2026, it is not a case where the contractual dues are admitted to the respondents and are not being paid for other reasons. The issue whether the petitioner discharged the works contract and if so, to what extent is it contested by the respondents, would require either adjudication upon a regular trial held by a Court of civil jurisdiction or by an Arbitrator, if in the contract there is an arbitration clause.
2. In this view of the matter, without prejudice to the rights and contentions of the parties, we are not inclined to entertain this petition.
3. It is dismissed with the above liberty. October 5, 2026 gp Versus Counsel for Petitioner(s) : Amita Kumari, Devendra Kumar Yadav Counsel for Respondent(s) : C.S.C. (Vivek Saran,J.) (J.J. Munir,J.)
