PP for the State respondent. 2. This is an application under Section 483 of BNSS, 2023 for granting bail to the petitioner namely Riyaj Rahman in connection with Palashbari P.S. Case No. 162/2026 registered Sections 61(2)/ 305(e) of BNS, 2023, who was arrested on 09.07.2026. Page No.# 2/3
3. The allegation against the petitioner is that the petitioner and his associates has committed theft of one Remote Radio Unit from an Airtel telecom site under Palashbari P.S. and on getting immediate information, the police chased the suspected offenders and apprehended the accused/ petitioner and his three associates managed to escape. The stolen article was recovered from the apprehended accused i.e. the present petitioner. The vehicle used by the accused for transporting the Remote Radio Unit was also seized. 4. The learned counsel for the petitioner submits that the petitioner is the driver of the vehicle and he has not involved with the alleged offence. Considering the length of detention his prayer may be considered. 5. The learned Addl. P.P. submits that the case diary has been received and the stolen article is a very expensive item and the accused was caught red handed. The earlier bail application in respect of the present petitioner being B.A. No. 1969 of 2026 was rejected by this Court by order dated 10.08.2026. 6. Be that as it may, by now, the petitioner has spent 54 days in custody. It is submitted by the leaned Addl. P.P. that charge sheet is yet to be submitted. 7. Having regard to the period of detention as well as the nature of the allegation, the prayer for bail is allowed.
Accordingly, the petitioner named above be released on bail on furnishing a bail bond of 50,000/- with 2 (two) sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup, Amingaon, subject to the conditions that the petitioner shall participate in the trial of the case as and when one commences and shall not try to influence or intimidate to any persons or witnesses acquainted with the facts of the case, in any manner. 8.
