HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 1146 of 2025 Court No. - 47 HON'BLE RAJEEV MISRA, J. HON'BLE JAI KRISHNA UPADHYAY, J. 1. Case called out in revised list. 2. Even though the name of Mr. Pradeep Kumar Shukla, Advocate is duly published in the cause list as counsel for petitioners but neither he nor any one on his behalf is present to press present writ petition even in revised call. 3. Learned A.G.A. for State-respondents 1, 2 and 3 is present. 4. Petitioner- Brijpal Chandra has approached this Court by means of present criminal misc. writ petition with the following prayer:- "i. To issue a writ order or direction in the nature of mandamus directing to the respondent no.2 and 3 for properly investigation will conduct and ensure the recovery of minor girl about the F.I.R. dated 02.08.2024 in Case Crime No. 0308 of 2024 under Section 137 of B.N.S. 2023, Police Station Navabganj, District Bareilly. ii. To issue any other writ order or direction as this Hon'ble Court which may deem fit and proper under the facts and circumstances of the case. iii. Award the cost of the petition in favour of the petitioner." 5. Upon perusal of the writ petition, we find that the FIR giving rise to present writ petition was lodged on 02.08.2024 and a period of more than two years have now expired since then. In all probability, the minor girl must have been recovered and upon completion of investigation, requisite report under Section 173(2) Cr.P.C. must have been submitted. We are, therefore, of the view that by the efflux of time, present writ petition has Versus Counsel for Petitioner(s) : Pradeep Kumar Shukla Counsel for Respondent(s) : G.A. Brijpal .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) been rendered infructuous. 6. It is accordingly, dismissed as having rendered infructuous. 7. Interim order, if any, stands vacated. October 5, 2026 Imtiyaz CRLP No. 1146 of 2025 2 (Jai Krishna Upadhyay,J.) (Rajeev Misra,J.)
