Respondent(s) For Appellants : Ms. Kiran Sahu, Advocate For Respondent No. 3 : Ms. Shrejal Gupta, on behalf of Mr. Vaibhal Shukla, Advocate Hon'ble Shri Justice Sachin Singh Rajput, Order on Board 16.04.2026 1) This appeal under Section 173 of Motor Vehicles Act, 1988 (for short “ MV Act”) has been filed by the appellant/claimant being aggrieved by the award dated 19.03.2021 passed in Claim Case No. 94/2018 by the learned Motor Accident Claims Tribunal, Surajpur, District Surajpur (CG). By the impugned award the learned Tribunal has awarded Rs. 2 69,000/- in favour of the appellant/claimant as compensation on account of grievous injuries received by him which took place on 22.04.2018 by the rash and negligent driving of respondent no. 1/driver of the offending vehicle i.e. car Scorpio bearing registration No. CG-15- CW-6368. 2) Learned counsel for the appellant submits that the amount awarded by learned tribunal is on the lower side which may be suitable enhanced. 3) Learned counsel for the respondent No. 3 supports the award and submits that just compensation has been awarded. 4) I have heard learned counsel for the parties and perused the record. 5) On perusal of record & evidence available, this Court deems it fit to award further sum of Rs. 30,000/- to make the compensation just. 6) Respondent No. 3 is directed to deposit an additional sum of Rs. 30,000/- within a period of 60 days from today, otherwise it will be liable to pay interest of @6% from the date of this order. 7) Consequently, the appeal is partly allowed.
