ORDER The application in A. No.1416 of 2026 in C.S. No.680 of 2012 has been filed by the plaintiff seeking leave to mark, as additional documents, six documents, namely, the letter of authorisation dated 19.12.2025, the ex parte orders dated 16.02.2023 and 06.06.2024, the 2008 KYC norms, the disciplinary-action papers against the fifth defendant, and the letter dated 25.09.2009 addressed to the second defendant Bank. The affidavit filed in support of the application itself states that what is sought to be produced are only xerox copies of those documents.

The averments in support of the application are that the authorisation letter came into existence only on 19.12.2025, that the two ex parte orders were passed after institution of the suit, that the KYC norms could not be obtained earlier, and that the remaining documents were not traceable at the time of filing of the plaint. On that basis, the plaintiff seeks permission to file the said xerox copies as additional documents through PW2. 3/5 https://www.mhc.tn.gov.in/judis
A.No.1416 of 2026 3.This Court is not inclined to grant the relief sought. What is admittedly sought to be received are only xerox copies. In the absence of a proper case made out for reception of secondary evidence, xerox copies cannot be received as additional documents merely on request. The affidavit does not set out the necessary particulars for bringing the case within section 63 and 65 of the Evidence Act. A mere xerox copy of a document cannot be admitted as secondary evidence in the absence of foundational proof satisfying Sections 63 and 65 of the Evidence Act. [H. Siddiqui v. A. Ramalingam, (2011) 4 SCC 240] Therefore, the prayer to receive the said xerox copies as additional documents cannot be entertained. 4.Accordingly, the application stands dismissed.
