Heard learned counsel for the petitioner, Sri Anoop Tiwari, learned counsel for respondent nos. 1 and 2 and learned A.G.A. for the State. 2. The petition is filed with the following prayers:- "I. Issue a writ order or direction directing the Judicial Magistrate/Additional Judicial Magistrate, Court No.23, Azamgarh to decide the application dated 25.08.2026 preferred by the petitioner for granting permission/NOC in case no.11522 of 2023 (State Vs. Mithilesh Kumar and others) arising out case crime no.46 of 2023 under Section 143, 147, 341, 332, 353, 504, 506, 188, 269 I.P.C. and 7 C.L.A Act, Police Station Gambhirpur, District Azamgarh, as per notification dated 25.08.1993 issued by the Ministry of External Affairs forthwith or as time stipulated by this Hon'ble High Court. II. Issue a writ order or direction directing direction may be given to the Judicial Magistrate, Court No.23, Azamgarh to grant permission/NOC as per law laid down by division bench of this Hon'ble Court in the case of Pawan Kumar Rajbhar Vs. Union of India and 2 others) decided on 10.09.2024 within stipulated period of time as prescribed by this temple of justice." 3. Learned counsel for the petitioner submits that petitioner has moved an application before the court concerned for grant of no objection for issuance of passport, the same is pending consideration before the court Versus Counsel for Petitioner(s) : Deepak Kumar Pandey, Jitendra Singh Gaur, Ravi Lal Gupta Counsel for Respondent(s) : A.S.G.I., Anoop Tiwari, G.A. Considering the facts and circumstances of the case and the submission of learned counsel for the petitioner, the petition is disposed of with a direction to the Judicial Magistrate/Additional Judicial Magistrate, Court No.23, Azamgarh to decide the application dated 25.8.2026 preferred by the petitioner for grant of permission/NOC in Case No.11522 of 2023 (State Vs. Mithilesh Kumar and others) arising out of Case Crime No. 46 of 2023 under Sections 143, 147, 341, 332, 353, 504, 506, 188, 269 I.P.C. and 7 C.L.A Act, Police Station Gambhirpur, District Azamgarh, as per notification dated 25.8.1993 issued by the Ministry of External Affairs, within a period of one month from the date of production of a certified copy of this order.
