Heard learned counsel for the petitioner and learned Standing Counsel for the respondent State. Sri Arun Kumar Pandey, Advocate has accepted notice on behalf of Gaon Sabha. 2. The present writ petition has been filed seeking a direction to the respondent nos.2 to 5 to remove the illegal encroachment made by encroachers over Plot No.122 area 0.1380 hectare, recorded as Khad Ka Gaddha in the relevant revenue records, relating to Village Pipal Gaon, Tehsil Moradabad, District Moradabad. 3. Today when the case was taken up, learned Standing Counsel has placed before the Court the instructions dated 3.10.2026 sent by Deputy District Magistrate, Sadar, District Moradabad, which is taken on record. 4. Perusal of the aforesaid instructions shows that on the basis of report of Lekhpal dated 19.9.2026, Case No. T202613540130260 has been registered against the respondent no.6 under Section 67 of the U.P. Revenue Code, 2006, which is pending consideration, in which 15.10.2026 is the next date fixed. 5. In view of the aforesaid, the present writ petition is disposed of with direction to the respondent no.4 to decide the aforesaid pending case, in accordance with law, after hearing the parties concerned, within a period of three months from the date of presentation of a certified copy of this order.
