HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 15560/2026 CNR: RJHC020685832026 | URN: CW / 33170U / 2026 Yogesh Mittal S/o Shri Banwari Lal, Aged About 45 Years, R/o Shyam Sarovar Colony, Bayana, Bharatpur, Rajasthan. ----Petitioner Versus
1. The State Of Rajasthan, Through The Secretary, Local Self Development Department, Government Secretariat, Jaipur (Rajasthan). 2. The Director, Directorate Of Local Bodies (DLB), Jaipur (Rajasthan). 3. The Secretary, Water Resources Department, Government Secretariat, Jaipur (Rajasthan). 4. The District Collector, Bharatpur, (Rajasthan). 5. The Executive Officer (EO), Nagar Palika, Roopwas, Bharatpur. 6. The Executive Engineer, Water Resources Department, Block Bharatpur. 7. The Executive Engineer, Water Resources Department, Block Bayana, District Bharatpur. ----Respondents For Petitioner(s) : Mr. Sukhdev Singh Solanki For Respondent(s) : Mr. V. D. Gathala, AGC HON'BLE MR. JUSTICE ANAND SHARMA Order 14/08/2026
1. Petitioner has challenged the order dated. 27.05.2026 issued by the Executive Officer, Municipal Board, Roopwas, whereby application for conversion of land and grant of patta submitted by the petitioner in respect of Khasra No. 656/312, measuring 2000 square meters has been turned down. Alternatively, prayer made
(2 of 3) [CW-15560/2026] by the petitioner is to direct the respondents to refund the processing fee of the application as well as for conversion fee of land in question. It is submitted that the petitioner deposited Rs. 10,21,000/- under the aforesaid head, therefore, in case, it is not possible to convert the land and to issue Patta then the amount deposited by the petitioner cannot be withheld by the respondent, therefore they may be directed to refund the same. 2. Heard learned counsel for the petitioner and perused the record. 3. A bare perusal of order conveying information dated 27.05.2026 would make it clear that land for which conversion was sought and request was made to issue Patta has been found as per record as catchment area Kundanwada Dam, which is admittedly a Water body and therefore, in the light of judgment passed by Division Bench of this Court at Principal Seat, Jodhpur Abdul Rahman Vs. State of Rajasthan & Ors. ( DB. Civil Writ Petition No. 4441/2021) decided on 19.03.2021, the authorities have committed no mistake in not accepting the request for change of land use and grant of patta. Hence, there is no scope of interference in order dated 27.05.2006 in the present writ petition. 4.
So far as, alternative prayer made by the petitioner with regard to refund of conversion fees as deposited by the petitioner, this Court finds it appropriate to grant liberty to the petitioner to submit a representation before the competent authority for refund of conversion fees as deposited by the petitioner for processing his application. Upon receiving such application, the competent authority shall consider the same in accordance with law and shall
(3 of 3) [CW-15560/2026] pass a speaking and reasoned order within a period of one month thereafter. In case, the competent authority comes to the conclusion that the amount deposited by the petitioner requires to be returned after deduction of administrative charges, if any, same shall be returned by the competent authority within the aforesaid period. 5. The writ petition stands disposed of accordingly. 6. Pending application(s), if any, stand(s) disposed of. (ANAND SHARMA),J 15/EKTA SAINI
