The petitioner, aggrieved by the inaction of Respondent No.4 in failing to decide his application for compassionate appointment, has filed this petition seeking appropriate directions. 2. The petitioner has prayed for the following reliefs : 10.1 That, this Hon'ble Court may kindly be please to direct the respondent authority to consider the candidature of petitioner for appointment on the post Assistant III/Assistant Teacher on compassionate basis 10.2 To kindly grant any other writ/ writs, order/ orders, relief/ reliefs in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner. 3. Learned counsel for the petitioner submits that on account of death of the father of the petitioner in harness, the petitioner has filed an application for grant of compassionate appointment before the Deputy Director, Veterinary Health Services-respondent No.4. He submits that although the death occurred on 31.7.1997, the petitioner was minor at that point of time and the application was eventually filed on 29.1.2007. Learned counsel for the petitioner submits that despite passage of a considerable time, the application has not yet been decided. Hence, learned counsel for the petitioner makes a limited prayer to decide the aforesaid application within a specified time frame. 4. Considering the submissions made by learned counsel for the petitioner and the averments made in the petition, it is evident that the application for grant of compassionate appointment is yet to be decided. If the application has not been decided till date, the authorities concerned are directed to decide the same in accordance with law 3 within a period of 45 days from the date of receipt of a copy of this order. However, if the application has already been decided, the respondent authority shall provide the petitioner with a copy of the order, so that he may challenge the same before the Appellate Authority in the event any adverse order has been passed against him. 5. The petitioner shall furnish a copy of this order before the concerned authority within a period of 7 days from the date of receipt of a copy thereof. 6.
